READ CAREFULLY BEFORE SIGNING
In consideration of being allowed to participate in any way in the martial arts programs, classes, events, or activities, including but not limited to Brazilian Jiu-Jitsu, Kickboxing, and Conditioning for Martial Arts (collectively, the “Activities”) at Jorge Pereira Jiu Jitsu Academy (the “Academy”) in Miami, Florida, the undersigned acknowledges, appreciates, and agrees to the following:
1. Acknowledgment of Risk
I understand that participation in the Activities involves inherent risks, including but not limited to physical injury, permanent disability, paralysis, or death. These risks may arise from:
• Physical exertion, contact, or impact during sparring, training, or conditioning, including joint locks, submissions, and strikes.
• Use of mats, training equipment, or facilities.
• Actions of myself, other participants, instructors, or third parties.
• The physical condition of the facilities or equipment. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Academy, its owners, instructors, employees, agents, or other participants (collectively, the “Released Parties”).
2. Health and Physical Condition
I stand for that I, the undersigned, (or the minor participant, if applicable) am in good physical health and have no medical conditions, injuries, or impairments that would prevent safe participation in the Activities. I agree to inform the Academy of any medical conditions or changes in health that may affect participation, including but not limited to joint issues, heart conditions, or respiratory concerns. I understand that it is my responsibility to consult with a physician prior to participation if I have any concerns about my (or the minor’s) ability to safely engage in Brazilian Jiu-Jitsu, Kickboxing, or Conditioning classes.
3. Release and Waiver of Liability
I, the undersigned, for myself (or on behalf of the minor participant), my heirs, assigns, personal
representatives, and next of kin, hereby release, discharge, and covenant not to sue the Released Parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me (or the minor participant) while participating in the Activities, whether caused by the negligence of the Released Parties or otherwise.
4. Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all liabilities, claims, damages, or expenses, including attorneys’ fees, arising out of my (or the minor participant’s) participation in the Activities, whether caused by my own actions, the actions of the minor, or the negligence of the Released Parties.
5. Assumption of Responsibility for Minors (For Participants Under 18)
If signing on behalf of a minor participant, I stand for that I am the parent or legal guardian of the minor named below and have the legal authority to execute this waiver on their behalf. I acknowledge that the minor will take part in Activities involving physical contact, such as Brazilian Jiu-Jitsu submissions, Kickboxing strikes, and intense conditioning exercises, which carry inherent risks. I assume full responsibility for any injuries or damages sustained by the minor. I agree to supervise or arrange for proper supervision of the minor during all Activities, if required by the
Academy.
6. Use of Likeness
I grant Jorge Pereira Jiu Jitsu Academy permission to use my (or the minor participant’s) likeness, image, or video in photographs, videos, or other media taken during the Activities for promotional, advertising, or other purposes (e.g., website, social media, or flyers) without compensation.
7. Rules and Conduct
I agree to abide by all Academy rules, policies, and instructions provided by instructors or staff, including those related to safety, attire (e.g., gi or no-gi for Jiu-Jitsu, gloves for Kickboxing), and respectful conduct. I understand that failure to comply may result in my (or the minor’s) removal from the Activities without refund. The Academy reserves the right to refuse service to anyone for any reason.
8. Emergency Medical Treatment
In case of an injury or medical emergency, I authorize the Academy to secure medical treatment for me (or the minor participant) and understand that I will be responsible for any associated costs. I agree to provide accurate emergency contact and medical information to the Academy.
9. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this agreement shall be resolved in the courts of Miami-Dade County, Florida.
10. Acknowledgment of Understanding
I have read this waiver and release of liability, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by Florida law.
